Oil exploration and exploitation project in Virunga National park: Threats against civil society in North-Kivu.
Civil Society focusing on environmental issues in North-Kivu is highly concerned about the security situation of its members in North-Kivu, Democratic Republic of Congo.
In fact, the end of January and the beginning of February 2014 were marked by decisive activism for the exploration and exploitation of oil within Virunga National Park. Three strong moments marked this activism:
- On 31st International, the Congolese government, in partnership with SOCO organized a workshop in Goma for “awareness on oil exploration and exploitation within protected areas in the DRC: the case of Virunga National Park.”
As a team of facilitators, the workshop was attended by His Excellency the National Minister of Hydrocarbons, the General Secretary of Hydrocarbons, the Representant of His Excellency the National Minister of the Environment, Nature conservation and
Tourism, His Excellency the Governor of North-Kivu province, the National Deputy and member of the Environment Commission of the National Assembly (moderator of the workshop).
- According to information circulated by certain radio and television channels, local communities living in or around Virunga National Park organized several demonstrations against the oil project between 31st at the same time as the workshop organized by the government took place.
- On 31st October 2013, the Director of Technology and Science at the ICCN, Guy Mbayima, addressed an unnumbered letter to the General Director of the ICCN with the subject: “Relevant recommendations from the workshop on the issue of oil exploration and production in protected areas in the DRC: the case of Virunga National Park (ViPN)”.
Further, members of civil society who expressed themselves at the workshop on 31st of January 2014 are currently under threat and fear for their security. These threats are, roughly speaking:
(i) Members of civil society are accused of wanting to create new armed groups and of opposing the authority of the state.
(ii) Civil society is also reproached of inviting the population to civil disobedience, sabotaging the state’s authority, using children in a demonstration at Kyavinyonge and planning a deadly coup against the Director of Technology and Science at the ICCN.
(iii) The threat to shut-down offices of civil society organisations and to prohibit the execution of activities in certain zones of North-Kivu
With regards to these unfounded accusations and waiting for a point-by-point response to Mr Guy Mbahima’s letter, we fear that our members on the ground and in Goma suffer death threats, arbitrary arrests, illegal detentions and torture by those who do not want that the local communities and the Civil Society of North-Kivu express their opinion on the oil exploration and exploitation project in ViNP freely. We also see a clear reduction in the scope of actions by civil society organisations commenting on oil development in the Great Lakes Region.
As a reminder, the Constitution of the Democratic Republic of Congo guarantees the freedom of thought, expression, demonstration and association in Articles 22, 23, 26, 37 and 61.
Civil Society of North-Kivu requests the competent authorities to accord a special protection to its members, in particular to the members of Reseau CREF, IDPE, CREDDHO, SOPR, EST and the parties responsible for the provincial coordination of civil society in North-Kivu.
Actions required
Thank you for calling and writing to the authorities of the DRC to ask them:
(i) To ensure the protection of civil society’s actors and to conduct an immediate, efficient, exhaustive, independent and impartial investigation into these accusations outlined in the letter written by the Director of Technology and Science at the ICCN.
(ii) To guarantee the respect for human rights and fundamental freedoms throughout the country in accordance with the national law and international instruments of human rights.
(iii) To protect local communities, primary beneficiaries of civil society actions and the NGOs partners of the Congolese government

Projet d’exploration et d’exploitation pétrolière dans le Parc National des Virunga : Menaces à l’égard de la Société Civile du Nord-Kivu.
La Société Civile du Nord-Kivu, thématique Environnement est fortement inquiétée de la situation sécuritaire de ses membres au Nord-Kivu, République Démocratique du Congo
En effet, la fin du mois de janvier et le début de celui de février 2014 ont été marqués par un activisme déterminant pour l’exploration et l’exploitation du pétrole dans le Parc National des Virunga. Trois moments forts ont marqué cet activisme :
- Le 31 janvier 2014, le gouvernement congolais, en partenariat avec SOCO international, a organisé, à Goma, un atelier de «sensibilisation sur l’exploration et production pétrolière dans les aires protégées en RDC : Cas du Parc National des Virunga».
Les travaux ont connu la participation de Son Excellence Monsieur le Ministre National des Hydrocarbures, le Secrétaire Général du Ministère des Hydrocarbures, le Représentant de son Excellence Monsieur le Ministre National de l’Environnement, Conservation de la Nature et Tourisme, Son Excellence Monsieur le Gouverneur de la Province du Nord-Kivu, le député national et membre de la Commission Environnement de l’Assemblée Nationale (modérateur de l’atelier); comme équipe des facilitateurs ;
- Parallèlement à l’atelier du gouvernement, à en croire les informations diffusées sur certaines chaînes radiotélévisées, plusieurs manifestations de protestation contre le projet pétrolier dans le parc été organisées par des communautés locales vivant dans ou autour du Parc National des Virunga, entre le 31 janvier et le 3 février2014 ;
- La lettre sans numéro du 31 Octobre 2013 du Directeur Technique et Scientifique de l’ICCN, Monsieur Guy MBAYIMA, adressée au Directeur Général de l’ICCN, avec comme objet : “Pertinente recommandation de l’atelier sur la problématique de l’exploration et production pétrolière dans les aires protégées de la RDC : Cas du Parc National des Virunga (PNVi)”;
Par ailleurs, les membres de la Société Civile qui se sont exprimés à l’atelier du 31 janvier 2014 sont actuellement menacés et craignent pour leur sécurité. Ces menaces sont, grosso-modo, détaillées dans la susmentionnée lettre :
(i) Les membres de la Société Civile sont accusés de vouloir créer de nouveaux groupes armés et de s’opposer à l’autorité de l’Etat;
(ii) Il est aussi reproché à la société civile d’appeler la population à la désobéissance civile; de sabotage de l’autorité de l’Etat, d’utilisation des enfants dans une manifestation à Kyavinyonge et de planifier un coup mortel contre le Directeur Technique et Scientifique de l’ICCN;
(iii) La menace de fermeture des bureaux des Organisations de la Société Civile et interdiction d’exécution des activités dans certaines zones au Nord-Kivu.
Au regard de ces affirmations sans fondement et, en attendant une réaction point par point à la lettre de Monsieur Guy MBAHIMA, nous craignons que nos membres sur le terrain et à Goma subissent des menaces de mort, des arrestations arbitraires, des détentions illégales et tortures par ceux qui ne veulent pas que les communautés locales et la Société Civile du Nord-Kivu expriment librement leurs opinions sur le projet d’exploration et l’exploitation du pétrole dans le PNVi. Nous voyons aussi une réduction claire du champ d’action des organisations de la société civile s’exprimant sur le développement pétrolier au niveau de la Région des Grands Lacs
En guise de rappel, la Constitution de la République Démocratique du Congo, à ses articles 22, 23, 26, 37 et 61, garantit la liberté de pensée, d’expression, de manifestation et d’association.
La Société Civile du Nord-Kivu demande aux autorités compétentes qu’une protection spéciale soit accordée à ses membres, particulièrement les membres du Réseau CREF, IDPE, CREDDHO, SOPR, EST et les responsables de la coordination provinciale de la société civile du Nord-Kivu.

i. Garantir une protection aux acteurs de la société civile et mener une enquête immédiate, efficace, exhaustive, indépendante et impartiale sur ces allégations détaillées dans la lettre du Directeur Technique et Scientifique de l’ICCN ;
ii. Garantir le respect des droits de l’homme et des libertés fondamentales à travers le pays selon les lois nationales et les instruments internationaux des droits de l’homme ;
iii. Protéger les communautés locales, premiers bénéficiaires, des actions de la Société Civile et les ONG, partenaire du Gouvernement Congolais,
